Okiya Omtatah, a senator from Busia, has petitioned the court for an injunction to halt the Independent Electoral and Boundaries Commission’s continuing appointment of its chairperson and six other members. (IEBC).
Mr. Omtatah is asking the court to strike down a legislation that made it possible to alter the makeup of the selection committee in charge of hiring IEBC members.
Because senators ignored the report of the Senate’s Standing Committee on Justice, Legal Affairs, and Human Rights when they approved the law in January of this year, he is asking for a ruling that the IEBC (Amendment) Act No.1 of 2023 is unconstitutional.
Despite the fact that the legislation already specifies the selection process, opposition leader Raila Odinga has been calling for the recruitment process to be stopped and the participation of all political groups.
